However, in the past, NRC concurrence in State and local emergency plans has not been required as a condition of nuclear power plant operation. We now are requiring, pending the results of a proposed rule change, that NRC concurrence in State and local emergency response plans be obtained as a condition for issuing an operating license.

Four years later this was followed by the Guide and Check List for the Development and Evaluation of State and Local Government Radiological Emergency Response Plans in Support of Fixed Nuclear Facilities (NRC, 1974), which provided the first guidance on the structure, content, and evaluation of the offsite emergency plans necessary to provide medical, fire, and law enforcement assistance to power plants and to implement protective actions for members of the public. This document was superseded in 1978 by the Planning Basis for the Development of State and Local Government Emergency Response Plans in Support of Light Water Nuclear Power Plants (NRC, 1978a), which was the product of a joint Nuclear Regulatory Commission and Environmental Protection Agency task force, primarily in 45 FR 55402, effective November 3, 1980.
