On November 4, 1979, due to the Shah’s presence in the United States, a mob once again raided the American Embassy in Tehran, this time taking sixty-six hostages. Fearing for their lives, the Carter administration now became desperate for the Shah to leave despite the fact that his blood counts dropped precipitously, indicating that removal of the spleen (a procedure carrying about a 15 percent risk of death) was a necessity. The operation could have been performed in Mexico, which had refused to allow his return.

The error stemmed from the hospital lab which reversed the results, and no one rechecked.  In 2003, led by the Bush White House and Senate Majority Leader Bill Frist (R-TN), himself a Tennessee heart-lung transplant surgeon, Congress took up legislation to cap medical malpractice jury verdicts for non-economic damages—generally termed “pain and suffering”—at $250,000. Frist had argued vociferously about “frivolous” suits, and especially a case brought by an elderly woman scalded by a cup of coffee clenched between her legs that she had purchased at a McDonald’s drive-through.
